BRAIN TOOL KIT APP — TERMS OF USE 

1. ACCEPTANCE OF TERMS 

By downloading and using the Brain Tool Kit App ("App"), you agree to these Terms of Use. If you do not agree, do not use the App. 

2. WHAT IS THE BRAIN TOOL KIT APP? 

The Brain Tool Kit App is an educational and informational tool. It is: 

  • An offline app that runs entirely on your device 

  • Designed to provide educational information and tools 

  • Not a medical device or diagnostic tool 

  • Not a replacement for professional medical advice or treatment 

3. NOT MEDICAL ADVICE 

IMPORTANT: The Brain Tool Kit App is not a substitute for professional medical, psychological, or healthcare advice. Nothing in this App constitutes: 

  • Medical diagnosis or treatment 

  • Professional medical advice 

  • Mental health counseling or therapy 

  • Prescriptions or treatment plans 

If you experience symptoms, health concerns, dizziness, balance issues, vision problems, or any medical condition, consult a qualified healthcare professional immediately. 

4. WHO CAN USE THIS APP? 

You must be of legal age of majority in your place of residence to use this App. By downloading and using the App, you represent that you meet this requirement. 

5. HOW THE APP WORKS 

5.1 Offline-Only App 

The Brain Tool Kit App operates entirely on your device. No data is sent to Brain Tool Kit Inc. servers, no account is required, and no personal information is collected. 

5.2 Your Data Belongs to You 

All data you create, input, or generate within the App remains on your device. You are solely responsible for backing up your data. When you delete the App, all associated data is removed from your device. 

We cannot access, recover, or restore your app data. 

6. INTELLECTUAL PROPERTY 

The Brain Tool Kit App and all its content, including design, functionality, text, graphics, and materials, are owned by Brain Tool Kit Inc. and protected by copyright and intellectual property laws. 

You may use the App for your personal use only. You may not: 

  • Reverse engineer, decompile, or attempt to discover the App's source code 

  • Reproduce, distribute, or transmit the App or its content 

  • Modify or create derivative works from the App 

  • Use the App for commercial purposes 

The license granted to you is non-exclusive, non-transferable, and revocable. 

7. NO WARRANTY & LIMITATION OF LIABILITY 

7.1 As Is 

The App is provided "as is" and "as available" without any warranty, express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement. 

7.2 No Liability 

To the maximum extent permitted by law, Brain Tool Kit Inc. is not liable for: 

  • Any indirect, incidental, special, or consequential damages 

  • Loss of data, profits, revenue, or business 

  • Actions taken or not taken based on App information 

  • Technical failures, interruptions, or bugs 

  • Any harm to your health or physical condition 

Our total liability is limited to $100 CAD or the maximum amount permitted by law. 

8. PROHIBITED USE 

You agree not to: 

  • Hack, crack, or attempt unauthorized access 

  • Reverse engineer or decompile the App 

  • Introduce viruses, malware, or harmful code 

  • Use the App in any illegal or harmful way 

9. APPLE APP STORE & GOOGLE PLAY STORE 

The Brain Tool Kit App is distributed through the Apple App Store and Google Play Store. Your use of the App is also governed by: 

In the event of a conflict between these Terms and Apple or Google's terms, the App Store terms apply to distribution and download; these Terms apply to App functionality and content. 

10. PRIVACY 

The Brain Tool Kit App does not collect personal information. See our App Privacy Policy (braintoolkit.ca/privacy/app) for details on: 

  • What data the App collects (none from BTK) 

  • What Apple and Google may collect about app installation 

  • Your privacy rights 

11. UPDATES & CHANGES TO APP 

We may update, modify, or discontinue the App at any time. Updates may require new versions to be downloaded from the App Store. We are not liable for any changes, bugs, or discontinuation of the App. 

12. TERMINATION 

We reserve the right to withdraw or discontinue the App from the App Store at any time. Your license to use the App terminates upon deletion of the App. 

13. GOVERNING LAW 

These Terms are governed by the laws of Ontario, Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Toronto, Ontario. 

14. CHANGES TO THESE TERMS 

We may update these Terms at any time. Changes will be posted with an updated "Last Updated" date. Your continued use of the App after changes constitutes acceptance.
