BRAIN TOOL KIT APP — TERMS OF USE

1. ACCEPTANCE OF TERMS 

By downloading or using the Brain Tool Kit App ("App"), you agree to these Terms of Use. If you do not agree, do not use the App. 

2. WHAT IS THE BRAIN TOOL KIT APP? 

The Brain Tool Kit App is an educational and informational tool. It is: 

  • an app that stores your data on your device 

  • designed to provide educational information and training tools 

  • not a medical device or diagnostic tool 

  • not a replacement for professional medical advice or treatment 

3. NOT MEDICAL ADVICE 

IMPORTANT: The Brain Tool Kit App is not a substitute for professional medical, psychological, or healthcare advice. Nothing in this App is: 

  • a medical diagnosis or treatment 

  • professional medical advice 

  • mental health counselling or therapy 

  • a prescription or treatment plan 

If you experience symptoms, health concerns, dizziness, balance issues, vision problems, or any medical condition, consult a qualified healthcare professional immediately. Stop any activity that makes your symptoms worse. 

4. WHO CAN USE THIS APP? 

You must be of the legal age of majority where you live to use this App. By downloading or using the App, you confirm that you meet this requirement. 

5. HOW THE APP WORKS 

5.1 Your Data Stays on Your Device 

The data you enter into the App is stored on your device. This includes your results, performance history, and symptom scores. No account is required, and this data is not sent to Brain Tool Kit Inc. 

An internet connection is used only to confirm purchases and BTK Pro access, as described in Section 6 and our App Privacy Policy. 

5.2 Backups and Deleting the App 

Your device may include App data in iCloud, Google, or computer backups, depending on your device settings. You are responsible for managing your own backups. 

Deleting the App removes its data from your device. It does not remove App data from existing device backups, or reports you have already shared. 

Brain Tool Kit Inc. cannot access, recover, or restore your App data. 

5.3 Sharing Your Data 

The App lets you create a report of your results and share it using your device's share options, such as email, text message, WhatsApp, or AirDrop. When you share, your information is sent through the service you choose, not through Brain Tool Kit Inc. 

Sharing is like sending an email or a screenshot. It is not fully secure. Once information leaves your device, Brain Tool Kit Inc. cannot see, retrieve, or delete it. You are responsible for deciding what you share and who you share it with. 

6. PURCHASES, BTK PRO, AND SUBSCRIPTIONS 

6.1 Purchases 

All purchases, including the App and BTK Pro, are processed by Apple or Google. Prices are shown in the App Store or Google Play Store before you buy. Brain Tool Kit Inc. never receives your payment details. 

6.2 Subscriptions 

If you buy a BTK Pro subscription: 

  • payment is charged to your Apple or Google account when you confirm your purchase 

  • your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it renews 

  • you can manage or cancel your subscription in your Apple or Google account settings 

  • deleting the App does not cancel your subscription 

6.3 Refunds 

Refunds are handled by Apple or Google under their policies. Brain Tool Kit Inc. cannot issue refunds directly. 

6.4 Purchase Verification 

We use a service called RevenueCat to confirm your purchase and unlock BTK Pro. RevenueCat receives only limited purchase information and never your results or health information. See our App Privacy Policy for details. 

7. INTELLECTUAL PROPERTY 

The App and its content, including design, functionality, text, graphics, and materials, are owned by Brain Tool Kit Inc. and protected by copyright and intellectual property laws. The Brain Tool Kit name and logo are trademarks of Rehab Lab Inc. 

You may use the App for your personal, non-commercial use only. You may not: 

  • reverse engineer, decompile, or attempt to discover the App's source code 

  • reproduce, distribute, or transmit the App or its content 

  • modify or create derivative works from the App 

  • use the App for commercial purposes 

This licence is non-exclusive, non-transferable, and revocable. 

8. NO WARRANTY AND LIMITATION OF LIABILITY 

8.1 As Is 

The App is provided "as is" and "as available" without any warranty, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. 

8.2 Limitation of Liability 

To the maximum extent permitted by law, Brain Tool Kit Inc. is not liable for: 

  • any indirect, incidental, special, or consequential damages 

  • loss of data, profits, revenue, or business 

  • actions taken or not taken based on App information 

  • technical failures, interruptions, or bugs 

  • any harm to your health or physical condition 

  • information you choose to share outside the App 

Our total liability is limited to the amount you paid for the App and BTK Pro in the 12 months before the claim, or $100 CAD, whichever is greater, or the maximum amount permitted by law. 

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. 

9. PROHIBITED USE 

You agree not to: 

  • hack, crack, or attempt unauthorized access to the App or BTK Pro features 

  • reverse engineer or decompile the App 

  • introduce viruses, malware, or harmful code 

  • use the App in any illegal or harmful way 

10. APPLE APP STORE AND GOOGLE PLAY STORE 

The App is distributed through the Apple App Store and Google Play Store. Your use of the App is also governed by: 

  • Google Play Terms of Service: play.google.com/about/play-terms 

If there is a conflict, Apple's or Google's terms apply to distribution, download, and payment, and these Terms apply to App functionality and content. 

If you downloaded the App from the Apple App Store, you also agree that: 

  • these Terms are between you and Brain Tool Kit Inc., not Apple 

  • Apple has no obligation to provide maintenance or support for the App 

  • if the App fails to meet any applicable warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation 

  • Apple is not responsible for any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims 

  • Apple is not responsible for investigating or defending any claim that the App infringes a third party's intellectual property rights 

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you 

11. PRIVACY 

Your App data stays on your device. The only information that leaves your device is limited purchase information used to confirm BTK Pro access. See our App Privacy Policy at braintoolkit.ca/privacypolicy for details on: 

  • what is stored on your device 

  • how sharing works 

  • what purchase information is collected 

  • what Apple and Google may collect 

  • your privacy rights 

12. UPDATES AND CHANGES TO THE APP 

We may update, modify, or discontinue the App or any feature at any time. Updates may need to be downloaded from the App Store or Google Play Store. We are not liable for any changes, bugs, or discontinuation of the App. 

13. TERMINATION 

We may withdraw the App from the App Store or Google Play Store at any time. We may end your licence if you break these Terms. Your licence ends when you delete the App. 

Deleting the App does not cancel an active subscription. See Section 6.2. 

14. GOVERNING LAW 

These Terms are governed by the laws of Ontario, Canada. Any disputes are subject to the exclusive jurisdiction of the courts of Toronto, Ontario, except where the consumer protection laws of your place of residence give you other rights. 

15. CHANGES TO THESE TERMS 

We may update these Terms at any time. Changes will be posted with an updated "Last Updated" date. If you keep using the App after changes are posted, you accept the updated Terms.
